Hello. My name is Brian Falker. It is with a heavy heart I must inform you that I have been told by ECRHA, PIHA, Narch, State Wars and USA Inline that my serves as a referee will never again be needed. I will deeply miss the roller hockey community I have been serving as a referee since 1999 and a player since 1983.
There was an incident two months ago, in November 2007. Over a two month period I was never told about the charges. There were three board meetings, none of which I was present for or invited to. My opinions of the events were never asked for until after I had been found guilty. The appeals process for me was a conference call, not a face to face meeting. Although I truly respect everyone who was a part of the decision I am disappointed at the lack of any due process. I was guilty until proven innocent which determined the rest of my career in a sport I have been associated with since 1983. I truly grew up in this sport, transitioning from a kid to college player to a referee. Unfortunately perceptions of me still seem to center around the young college student I was instead of the man I am now. I was notified of the final decision via e-mail, somewhat less of an explanation than I would have hoped. The other notifications (Narch, State Wars and PIHA) filtered in through both e-mail and text message respectively. My venue for airing both my concerns and story was limited and delayed. My side of the story will be made public but I do not feel this is the right time or place for that.
I am extremely thankful for all of the memories and people I have met through this sport. The roller hockey community has truly been an extension of my family from Boston to Florida to Chicago and Colorado. I would like to thank all the world class players I have had the pleasure of sharing the floor will over the last 9 years. Players like CJ Yoder, Jay Mazer, Brian and Steve Yingling, Dan Constanza, Jerry Osterkamp, Ron Tracy, Kevin Hollenbush, Greg Thompson, Jon Mosenson, John Pinheiro, Mike Hunt, Shawn Sullivan, Mike Keating and Dustin Roux have all made me a better referee and student of the game. Thank you very much gentlemen for your impacts on my life, they will never be forgotten.
A large part of my life has now been torn away but my memories will last forever. Memories of watching kids of all ages score their first goal, winning their first game and celebrate their first national championships can never be taken away. I will never forget the thousands of memories I have like when I was refereeing a 8 and under game at a Narch regional in Long Island and there was an energetic and entertaining little five year old in the game. At a face off all the parents were yelling and screaming and this kid says to me, “Don’t they know it’s just a game?” That’s some insight for a 5 year old. I’ll never forget the kids I watch grown up in front of me on the floor like Steven Stewart. When I first met Steven he was a tall skinny kid playing in a house league at Marple Sports Arena. He was under achieving in a B league. Now he is the best left handed goalie in the country and will be on the Drexel University Dragon’s ice hockey roster next year. Congratulations on the MVG and National Championship in Detroit. I also can still see the world’s best player (CJ Yoder) scoring a natural hat trick during a MLRH game, on a penalty kill, on the small rink at Marple Sports Arena. Memories like these won’t fade.
To all players, coaches, staff and referees I have had the pleasure of knowing and working with thank you for letting me grow up in this environment. I wouldn’t have had it any other way. Thank you for everything. One final thought to the sport of roller hockey, the future of this sport is tremendous. Respect the people who came before you and helped to pave your path, respect everyone who you come in contact with today and teach those below you the same skills and lessons you have learned. Thank you for everything!

If you don't mind my asking, what was the "incident"?

If things involving any investigation into a so-called "incident" transpired as you claim they have, it seems to me you were clearly denied the "due process" you are entitled to. Right now, it seems as though these "alphabet-soup" entities are interfering with your ability and RIGHT to earn a living -- and THAT my friend, is a legally "actionable" offense.

That they all also apparently have done so "behind closed doors", without your knowledge and without 'deposing' you (about your side of things) and have ultimately concluded their findings in a 'closed' and "collusionary" manner might be evidence of "restriction of trade", "tort" and anti-trust issues giving you even further "causes of action" worthy of serious financial reparations.

I'd consult a good business/employment lawyer if I were you.

Personally, I wouldn't allow yourself to be heartbroken over ANYTHING that USA Hockey-Inline might say or attempt to do to you, as llong with USA Hockey ('ice') they're going to be facing a very hot "legal fire" VERY SOON and quite frankly (after legal proceedings) might not be around too much longer.

How "SOON" is this (legal) fire going down?? Because you've been "talking about" it 'since' September. Just "wondering."

I'm not sure how these posts regarding potential lawsuits are appropriate for these Forums section. You have a beef with USA Hockey InLine that you apparently intend to take to court. If so, do so, but airing the potential case on these Forums is inappropriate, and I don't see how it furthers the growth of our great sport one iota.

I was just telling Brian ("HockeyRefGuy") that if things went down the way he said they did, then he clearly has legal options and redress and quite frankly, I'd pursue them. My invoking that he should not be worried in any way about confronting USA Hockey/USA Hockey-InLine (as some of us are) or any of these entities who would be essentially (and illegally) restricting Brian's ability to earn a living was about the fact that these entities are ONLY here at OUR interest, discretion and/or tolerance, not theirs' -- and filing (and eventually winning) a lawsuit legally reminds EVERYONE of this fact.

I don't see how reminding someone of "options" to protect their right to practice and/or pursue their livelihood and/or passion constitutes anything negative, but I'll definitely respect the IHC Forum rules and sensitivities about such subjects.

And "SOON" in the legal sense means in the very near future -- as in when the case and evidence and 'timing' is perfectly positioned, prepared and primed -- and not a moment "SOONER".

Don't worry, though -- I've already committed to a $1000 'ad-buy' on IHC regarding this event (as well as, YES, others being worked on), so you'll have the same chance as everyone else to sign-up and "take your best shot" at winning some Euros* (as your other "shots" definitely don't hit the target), OK, dude...!?!

*: It was 200,000 Euros, NOT E300,000 -- that is, unless you're a BIG-time sponsor already committing another 100K in Euros to an event that you OBVIOUSLY know absolutely nothing about. Get your FACTS straight BEFORE you take your "shots".

Well, aside form hearing any sides, I can only attest to Mr Falker's ability to officiate. He is one of few that even know what game management is, let alone implement it.

Let the truth set you free.

Now back to your regularly scheduled Saturday evening beer drinking action.

Haha, simmer down chief! I just asked what's happening with your event. The only shots I took were at your ridiculous writing style because those are always easy and fun to do.

I like how you insult me for being a small-time peon who knows NOTHING about your event but you also defend your right to not release information about it. Hmm...and do you still wonder why so many people think you come off like an arrogant tool?

And yeah, I was wrong about it being E300,000. I thought I remember you saying it was 300,000. I was wrong. Although, a quick look at your posts shows you did say, "it might even go higher to as much as 250,000 Euros" and "it's now more than 200,000 Euros, BTW)."

No idea why I was thinking it was more than 200,000...

First of all, this should be a post about Brian Falker being denied his rightful and expected due process. Maybe I was misunderstood in invoking a pending lawsuit against USA Hockey as a way to show him that he shouldn't allow himself to be either bullied, intimidated or mislead as to any of the entities right to essentially 'ban' him from officiating. I was just trying to tell him that if what he said was true about how things went down, then he probably should get a lawyer and go after them.

Secondly, I'd like you to show me the quote where I "insulted" (or insinuated) you as being "a small-time peon" -- you can't, because it was never done (however, if something inside of you makes you feel that way, all I can say is that's your problem, now isn't it). I only mentioned something that is an absolute fact: you don't know anything about the 200,000 Euro event because it's intended by everyone intimately involved that we keep it this way for now -- we'll obviously let everyone know once and when we're completely ready to announce and not one second sooner.

I would just let it go man. I read what you wrote and weren't out of line at all. You asked to questions that he could or could not have answered, they may have been in the wrong thread but that about the only thing you did wrong. It's pretty much pointless to extend this argument any further because we both know how it will turn out and it just gets old.

This thread has lost all direction.

Just what is "out of line" in your book -- accusing someone of saying something they didn't (like "alex" did)? Or would it be getting your facts wrong (as "alex" did)? Or could it be calling someone (including himself) derogatory names (like "alex" did)? Or should it be twisting the timbre, tone and meaning what was said and is in fact on the record into something not even remotely close (as "alex" did)? -- Whatever, dipsey-dudes -- "simmer down", indeed.

If anything, I'd call "alex's" completely inaccurate and irresponsible way with words and the truth a truly "ridiculous writing style".

And finally, the thread "lost all direction" because of what "alex" in fact did, not me.
